These terms and conditions of use (“Terms of Use”) of the Website (as defined below) between OnnMyTrip (Owner of onnmytrip.com) and the users/ registrants of the Website onnmytrip.com (“You” or “Your” or “Yourself” or “User”) describe the terms on which OnnMyTrip offers you access to the Website and the Services (as defined below) through the Website Onnmytrip.com

You agree that by accessing the site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

OnnMyTrip reserves the right to alter, change, modify, add or remove portions in whole or in part of these Terms at any time. Such changes shall be effective when posted on the Site. Notwithstanding anything to the contrary, it is Your responsibility for regularly reviewing the Terms, including amendments thereto as may be posted on the Site and shall be deemed to have accepted the amended Terms by continuing the use of Site.

Acceptance of terms

OnnMyTrip provides its service to you, subject to the following Terms of Use, which may be updated by us from time to time without notice to you. You can review the most current version of the Terms of Use at any time at – onnmytrip.com/termsofuse

In addition, when using particular onnmytrip.com services, shall be subject to any posted guidelines or rules applicable to such services which may be posted from time to time.

All such guidelines or rules are hereby incorporated by reference into the Terms of Use. OnnMyTrip also may offer other services from time to time that are governed by different Terms of Services.

Description of services

Onnmytrip.com currently provides users with access to the travel content of regions across the world clubbed with trip planning and social networking services. You also understand and agree that the Service may include advertisements and that these advertisements are necessary for OnnMyTrip to provide the Service.

You also understand and agree that the service may include certain communications from OnnMyTrip, such as service announcements, administrative messages and the onnmytrip.com Newsletter, and that these communications are considered part of Onnmytrip.com membership and you may be able to opt out of receiving them.

Unless explicitly stated otherwise, any new features that augments or enhances the current Service, including the release of new OnnMyTrip properties, shall be subject to this Terms of Use. You understand and agree that the Service is provided “AS-IS” and that OnnMyTrip assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

Trip Plans / Itineraries created by any user on onnmytrip.com will be considered public information and will be shown to other users using onnmytrip.com service. Onnmytrip.com can use these Trip Plans for any purpose that it deems fit for the benefit of Onnmytrip.com community.

OnnMyTrip will consider all user requests to register/unregister/unsubscribe users from the service. However since the service is free and the user information on onnmytrip.com is voluntarily posted by the user, OnnMyTrip cannot guarantee immediate actions on the same since this may have technical implications on the service and impact other users using the service.

OnnMyTrip assumes no responsibility for updation /deletion/display of any user data/information including profile information. For user requests of updation/deletion/display of any user data or information or profile information which has been voluntarily provided by the user for the benefit of Onnmytrip.com user community, OnnMyTrip cannot guarantee immediate actions on the same since this may have technical implications on the service and impact other users using the service.

OnnMyTrip will consider all user requests to register/unregister/unsubscribe users from the service. However since the service is free and the user information on onnmytrip.com is voluntarily posted by the user, OnnMyTrip cannot guarantee immediate actions on the same since this may have technical implications on the service and impact other users using the service.

You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

Your registration obligations

In consideration of your use of the Service, you agree to –

(a) provide true, accurate, current and complete information about yourself as prompted by the Service’s registration form (such information being the “Registration Data”) and

(b) Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or OnnMyTrip has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, OnnMyTrip has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

OnnMyTrip is concerned about the safety and privacy of all its users, particularly of children. For this reason, we advise that parents of children under the age of 14 who wish to allow their children access to the Service should accompany them while using onnmytrip.com services.

Please remember that the Service is designed to appeal to a broad audience. Accordingly, as the legal guardian, it is your responsibility to determine whether any of the Services and/or Content (as defined in Section 6 below) are appropriate for your child.

Member account, password and security

You will receive a password and account designation upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.

You agree to –

(a) Immediately notify OnnMyTrip of any unauthorized use of your password or account or any other breach of security, and

(b) Ensure that you exit from your account at the end of each session. OnnMyTrip cannot and will not be liable for any loss or damage arising from your failure to comply with this provision.

Your Holiday Contract

When a booking is made, the ‘lead name’ on the booking guarantees that he or she has the authority to accept and does accept on behalf of the party the terms of these booking conditions. After we receive your booking and all appropriate payments, if the arrangements you wish to book are available, we will issue a confirmation invoice. A binding agreement will come into existence between us when we dispatch this invoice to the ‘lead name’ or your Tour Operator / Travel Agent.

 It is important to check the details on your invoice when you get it, or if booking late at the time of booking, that all the details are exactly as you requested. In the event of any discrepancy, please contact us or your Tour Operator / Travel Agent immediately as it may not be possible to make changes later

Passports, visas, health requirements and travel documents

It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure. A full and valid passport is required for destinations we feature (including children) and Visas may be required for overseas destinations. Requirements may change and you must check the up to date position in good time before departure. By availing our services, you agree that OnnMyTrip can only help you apply for the visa and is not responsible for any issues that may occur during this application including, but not limited to, delay, clarification or rejection by the embassy.

Insurance

We consider adequate travel insurance to be essential. Please read and take it with you on holiday. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. OnnMyTrip cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. If you choose to travel without adequate insurance coverage, we will not be liable for any of your losses howsoever arising, which would have been covered had you purchased adequate insurance.

Paying for Your Holiday

In order to confirm your chosen arrangements, you may either pay a partial amount as chosen by the Tour Operator or pay in full. If you choose to pay a partial sum, the remainder of the amount should be paid within 3 days of paying the partial amount. Paying any of these amount secures the specific types of airline tickets, tours, land transport etc, and this will be confirmed to you at time of booking. If we do not receive this balance in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out below under the head “If you change your booking” will become payable. Cancellation fees, processing and booking amendment fees, as well as insurance premiums, are due immediately after invoicing by OnnMyTrip. The travel documents will be sent to the customer within 14 days after receipt of his final payment at OnnMyTrip. If the booking is made less than 30 days before arrival, the entire travel price is due immediately upon receipt of the written travel confirmation. We accept payment by credit card, debit card, internet banking and transfers to our bank accounts.

Convenience Fees

Convenience fees are applicable for all payments made after the date of booking, except for transfers into our Bank Account. We reserve the right to withdraw waivers for Convenience fees on payments made on day of booking.

Credit Card Fraud Contingency:

If you do not supply the correct credit or debit card billing address and/or cardholder information, the issue of your tickets may be delayed and the overall cost may increase. We reserve the right to cancel your holiday if payment is declined or if you have supplied incorrect credit card information. We also reserve the right to do random checks in order to minimise credit card fraud. As a result of this, before issuing tickets we may require you to provide us with a fax or postal copy of proof of address, a copy of your credit card and a recent statement.

Your Holiday Price

OnnMyTrip endeavours to ensure that the most up to date and correct prices are shown on our website. OnnMyTrip reserves the right to raise or lower their prices at any time. Occasionally, an incorrect price may be shown, due to an error. When OnnMyTrip become aware of any such error, we will endeavour to notify you at the time of booking (if we are then aware of the mistake) or as soon as reasonably possible. We reserve the right to cancel the booking if you do not wish to accept the price which is actually applicable to the holiday.

If You Change Your Booking

If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, we will do our utmost to make these changes, but it may not always be possible. Any request for changes to be made must be from the ‘lead name’ on the booking or your Tour Operator through OnnMyTrip.

You should be aware that these costs could increase the closer to the departure date that changes are made. Only one change of departure date, per booking may be permitted. Any change in departure date will be treated as a cancellation and full cancellation charges will apply.

Note: Certain arrangements may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements. In some cases, any changes made may mean you having to pay for the cancelled arrangements and purchasing new ones at full cost.

 

If You Cancel Your Holiday

You, or any member of your party, may cancel your travel arrangements at any time. Written notification by mail, fax or email from the ‘lead name’ on the booking or your Tour Operator on your behalf, must be received at our offices.

Note: if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges from your insurance company.

Our cancellation charges are a percentage of the total holiday cost. These charges are based on how many days before your departure we receive your cancellation notice and not when your correspondence was sent to us.

Please note that any amendment charges are non-refundable.

Please note, if only some members of your party cancel, in addition to incurring the applicable cancellation charges, we will recalculate the holiday cost for the remaining travellers. You may have to pay the extra room charges such as single room supplements. In cases where cancellation charges made by our suppliers are higher than the cost of the deposit, we may pass the charge on to you. Please ask for full details and we will notify you of the specific charges applicable to your booking.

If We Change or Cancel Your Holiday

Our Tour Operators begin planning the arrangements we offer many days in advance and so we reserve the right to make changes to and correct errors in holiday details both before and after bookings have been confirmed. We must also reserve the right to cancel confirmed bookings at any time.

Most changes are minor but occasionally, we may have to make a Major Change. If we have to make a Major Change or cancel, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of the following options:

(for Major Changes) accepting the changed arrangements or

Purchasing alternative arrangements from us, of a similar standard to those originally booked if available (if the chosen alternative is less expensive than your original one, we will refund the difference but if it is more expensive, we will ask you to pay the difference) or

Mode and Duration of Refund(s)

Refunds once initiated from our systems, are usually realised within 3-4 working days, but can take upto 21 working days to hit your accounts.

Refund will be initiated ONLY to the original mode of payment. In cases where refund is not possible to original mode of payment, refund may be done to buyer’s banking account, wherein we will need to do verification (KYC) and proof of ownership of account. The timeline of the verification can vary from 7-15 working days.

All Paypal refunds, after 60 days of transaction, will be done ONLY to the Paypal linked E-mail ID (quickest mode) used to make initial payment. Exceptions will be handled from case to case basis, but we do not entertain cross-currency refunds (Refund currency different from payment currency).

Flights

We are not always in a position at the time of booking to confirm the carrier(s), aircraft type and flight timings which will be used in connection with your flight. The carrier(s), flight timings and types of aircraft shown in this website and detailed on your confirmation invoice are for guidance only and are subject to alteration and confirmation. The latest timings will be shown on your tickets which will be despatched to you approximately two weeks before departure. You must accordingly check your tickets very carefully immediately on receipt to ensure you have the correct flight times. It is possible that flight times may be changed even after tickets have been despatched – we will contact you as soon as possible if this occurs. Any change in the identity of the carrier(s), flight timings, and/or aircraft type will not entitle you to cancel or change to other arrangements without paying our normal charges.

This website is our responsibility, as your tour operator. It is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements.

If You Have A Complaint

In the event that you have any reason to complain or experience any problems with your holiday arrangements whilst away, you must immediately inform the representative of the Tour Operator, OnnMyTrip and the supplier of the service(s) in question and complete a report form whilst in resort. Most problems or complaints can be resolved while you are away, however if you remain dissatisfied, please call us or write to support@onnmytrip.com within 7 days of your return giving your booking reference and full details of your complaint and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

Member conduct

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not OnnMyTrip, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. OnnMyTrip does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable.

Under no circumstances will OnnMyTrip be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

You agree to not use the Service to –

  • Defame, abuse, harass, threaten or otherwise violate the legal rights of others;
  • Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword;
  • Upload files that contain software or other material protected by applicable intellectual property laws unless You own or control the rights thereto or have received all necessary consents
  • Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another’s computer;
  • Engage in any activity that interferes with or disrupts access to the Website or the Services (or the servers and networks which are connected to the Website);
  • Attempt to gain unauthorized access to any portion or feature of the Website, any other systems or networks connected to the Website, to any OnnMyTrip server, or to any of the Services offered on or through the Website, by hacking, password mining or any other illegitimate means;
  • Probe, scan or test the vulnerability of the Website or any network connected to the Website, nor breach the security or authentication measures on the Website or any network connected to the Website. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Website, or any other customer of OnnMyTrip, including any Onnmytrip.com account not owned by You, to its source, or exploit the Website or Service or information made available or offered by or through the Website, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Website;
  • Disrupt or interfere with the security of, or otherwise cause harm to, the Website, systems resources, accounts, passwords, servers or networks connected to or accessible through the Websites or any affiliated or linked sites;
  • Collect or store data about other users in connection with the prohibited conduct and activities set forth in this Section.
  • Use any device or software to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Website, or with any other person’s use of the Website;
  • Use the Website or any material or Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of OnnMyTrip or other third parties;
  • Conduct or forward surveys, contests, pyramid schemes or chain letters;
  • Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
  • Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;
  • Violate any applicable laws or regulations for the time being in force within or outside India;Violate the Terms of Use including but not limited to any applicable Additional Terms of the Website contained herein or elsewhere; and
  • Reverse engineer, modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website.

You acknowledge that OnnMyTrip does not pre-screen Content, but that OnnMyTrip and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move or keep any Content that is available via the Service Onnmytrip.com. Without limiting the foregoing, OnnMyTrip and its designees shall have the right to remove any content that violates the Terms of Usage or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created on/for Onnmytrip.com, or submitted to Onnmytrip.com, including without limitation information in Onnmytrip.com Message Boards, Itineraries and in all other parts of the Service.

You acknowledge and agree that OnnMyTrip may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to –

(a) Comply with legal process.

(b) Enforce the Terms of Services.

(c) Respond to claims that any Content violates the rights of third-parties; or

(d) Protect the rights, property, or personal safety of Onnmytrip.com, its users and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve –

(a) Transmissions over various networks; and

(b) Changes to conform and adapt to technical requirements of connecting networks or devices.

Content submitted or made available for inclusion on the service

OnnMyTrip does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant OnnMyTrip the following world-wide, royalty free and non-exclusive license(s), as applicable –

With respect to Content you submit or make available for inclusion publically accessible features on Onnmytrip.com, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service for the purposes of providing and promoting Onnmytrip.com. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or OnnMyTrip removes such Content from the Service.

With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible area of the Service the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or OnnMyTrip removes such Content from the Service.

With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service the perpetual, irrevocable and fully sub-licensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

“Publicly accessible” areas of the Service are those areas of the service that will be available to the general public. By way of example, publicly accessible areas of the Service would include message boards, user profile pages, Itinerary views etc.

Indemnity

You agree to indemnify and hold OnnMyTrip, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the terms of usage, or your violation of any rights of another.

General practices regarding use and storage

You acknowledge that OnnMyTrip may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on OnnMyTrip servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time.

You agree that OnnMyTrip has no responsibility or liability for the deletion or updation or failure to store or storage of any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Onnmytrip.com reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that OnnMyTrip reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Modifications to service

OnnMyTrip reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that OnnMyTrip shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Termination

You agree that Onnmytrip, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if OnnMyTrip believes that you have violated or acted inconsistently with the letter or spirit of the terms of usage. OnnMyTrip may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice.

You agree that any termination of your access to the Service under any provision of this Terms of Use may be effected without prior notice, and acknowledge and agree that

OnnMyTrip may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that OnnMyTrip shall not be liable to you or any third party for any termination of your access to the Service.

Links

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. You acknowledge and agree that OnnMyTrip is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that OnnMyTrip shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

 OnnMyTrip proprietary rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws.

You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by OnnMyTrip, advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

Data protection/privacy

In order to process your booking and meet your requirements, we must pass your personal details on to the relevant suppliers of your travel arrangements. We would also like to hold your information (including any email address), where collected by us, for our own and for OnnMyTrip’s future marketing purposes (for example, to inform you of promotional/competition offers or to send you our brochure). If you do not wish to receive such approaches in future, please change your communication preferences in the website. For full details of our data protection and privacy policy, and an explanation of how your personal details will be used by us, please refer to our privacy policy.

Special requests and medical problems

If you wish to make a special request, you must do so at the time of booking. We will try to pass any reasonable requests on to the relevant supplier but we cannot guarantee that requests will be met. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed.

We are happy to advise and assist you in choosing a suitable holiday. As some of the accommodation and resorts featured may lack even the simplest facilities, such as ramps for wheelchairs, lifts etc, it is important that, when booking, you advise us of any disabilities and special requirements to make sure the holiday meets your specific needs. If we reasonably feel unable to properly accommodate the particular needs of the person(s) concerned, we will not confirm the booking or, if full details are not given at the time of booking, cancel when we become aware of these details. Disclaimer

You expressly understand and agree that –

a) Your use of the service is at your sole risk. The service is provided on an “as is”and “as available” basis. OnnMyTrip expressly disclaims all warranties of any kind ,whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

(b) OnnMyTrip makes no warranty that –

i) The service will meet your requirements,

ii) The service will be uninterrupted, timely, secure, or error-free,

iii) The results that may be obtained from the use of the service will be accurate or reliable,

iv) The quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and

v) Any errors in the software will be corrected.

(c) Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

(d) No advice or information, whether oral or written, obtained by you from OnnMyTrip or through or from the service shall create any warranty not expressly stated in the terms of usage.

Limitation of liability

You expressly understand and agree that OnnMyTrip shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if OnnMyTrip has been advised of the possibility of such damages), resulting from –

(i) The use or the inability to use the service;

You agree that OnnMyTrip may, in its sole discretion and without prior notice, terminate your access to the Website and block your future access to the Website if OnnMyTrip determines that you have violated these Terms of Use or Additional Terms. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to OnnMyTrip, for which monetary damages would be inadequate, and you consent to OnnMyTrip obtaining any injunctive or equitable relief that OnnMyTrip deems necessary or appropriate in such circumstances. Jurisdiction and Applicable Law

These Terms & Conditions and any agreement to which they apply are governed in all respects by the laws of the courts in Agra, India and the courts in Agra, India shall have exclusive jurisdiction without regard to conflicts of law principles. All guest claims must be submitted in writing and received by OnnMyTrip no later than sixty (60) days after the completion of the OnnMyTrip vacation. Guest claims not submitted and received within this time shall be deemed waived and barred.

If any part of these Terms of Use is determined to be indefinite, invalid, or otherwise unenforceable, the rest of these Terms shall continue in full force.
